Greetings:
In the name of the Commonwealth aforesaid, you are hereby required to notify and warn the inhabitants of the Town of Egremont qualified to vote in elections and Town affairs, to meet at the North Egremont Fire Station in North Egremont, on Tuesday, the 11th day of May, 2010, at 10:00 o'clock in the forenoon, and then and there to bring their ballots to the election officers for the election of the following Town and District Officers:
One Constable for three years,
One Moderator for one year,
One Town Clerk for one year,
One Selectman for three years,
One Library Trustee for three years,
One Cemetery Commissioner for three years,
One member of the Planning Board for five years,
One member of the Planning Board for two years,
One associate member of the Planning Board for two years,
One Tree Warden for one year,
One Assessor for three years,
One Water Commissioner for three years.
and to choose such other officers as towns are required by law or have a right to choose.
All of the above named officers will be voted upon an official ballot to be furnished at the polling place by the election officers.
The polls will open at 10:00 A.M., and shall close at 7:00 P.M.
You are also required to notify and warn the inhabitants of said Town qualified to vote in Town affairs to meet at the Mount Everett Regional High School, Thomas A. Consolati Auditorium,
Sheffield MA, on Tuesday, the 4th day of May, 2010 at 7:00 P.M. and then and there to act upon the following articles:

ARTICLE 5: To see if the Town will vote to change the following zoning bylaw section to read:
Section 5.3.10.9 Towers shall be located at least one and one half times their maximum structural height away from the outer boundary of any parcel of land where the tower is situated, and all related structures shall comply with all setbacks for accessory buildings in §4.1.2.1.b of this bylaw.

ARTICLE 7: To see if the Town will vote to change the following zoning bylaw section to read:
Section 5.3.12.3 The SPGA may waive the requirements of this §5.3 as to height of tower, adequate coverage, and distance from streams and wetlands if to do so will allow a facility that, in the opinion of the SPGA, will serve the wireless telecommunications needs of the town while still meeting the purposes and intent of §5.3.

ARTICLE 8: To see if the Town will vote to amend the Egremont Zoning Bylaws as follows:

4.1.2 Intensity Regulations for the General District
4.1.2.1 Table of Intensity Regulations
a. General
Any building or structure shall be so located on a lot as to meet the requirements of this Section, except as specifically otherwise provided in this Bylaw.
b. Table of Intensity Regulations

Notes:
1. Measured from the right-of-way line where a plan of the way is on file with the Registry of Deeds, or in the absence of such plan, the front set-back shall be a minimum of sixty-five (65) feet from the center line of the travel way.
2. The height restrictions do not apply to agricultural buildings or structures, spires, chimneys, antennae or other appurtenances usually placed above roof level and not intended for human occupancy.
3. For the first three (3) dwelling units plus one half (1/2) acre of usable land for each additional dwelling unit.
4. Except as provided in Section 4.1.2.3.b.ii.

Add to Definitions
2.0 Fence or Fence-like Structure: Any permanent partition, barrier or structure, including retaining walls and earthen berms, erected for the purpose of shielding land or the occupants thereof from view or noise; for providing security or protection to persons, animals, objects or structures located on or occupying land; for defining the boundary of a piece of land, enclosing a piece of land, or dividing a piece of land into distinct portions; or for retaining land for the purpose of changing the grade of the land.
Create a new section 4.3.6:
4.3.6 Fences
4.3.6.1 Applicability: This section shall apply to all fences and fence- like structures.
4.3.6.2 Materials: Only appropriate fencing materials shall be used for fences and fence-like structures, including those materials normally manufactured for, used as, and recognized as fencing materials, such as wood, stone, earth, vinyl, chain link, wire, wire mesh, concrete, fired masonry, wrought iron or other decorative metals suitable for fence construction.
4.3.6.3 Height and Setbacks:
(a) Measurement of fence height:
i. The height of a fence shall be measured by the vertical distance from the natural grade of the ground at the location where the fence is to be erected to the top of the fence section or panel.
ii. If the fence is to be erected on top of a wall or berm, the height of the fence shall be measured as the vertical distance from the natural grade of the ground at the base of the wall or berm to the top of the fence section or panel.
(b) No setback from the property boundary is required for
i. Fences four (4) feet in height or less.
ii. Fence posts extending up to four feet six inches (4’6”) as part of such fence.
iii. Gate posts and entry arbors, consisting of side posts and a connecting horizontal member, as part of such fence extending up to seven (7) feet in height.
(c) Fences greater than four (4) feet in height shall be set back from any property line abutting a public or private way by a minimum of fifteen (15) feet or 25% of the existing legal setback of the principal building on that lot, whichever is less.
(d) Fences greater than four (4) feet in height shall be set back from any property line not abutting a public or private way by a minimum of ten (10) feet or 25% of the existing legal setback of the principal building on that lot, whichever is less.
(e) Maximum height for fences shall be eight (8) feet except as provided under section 4.3.6.6 below.
(f) Agricultural fences confining farm animals or horses, protective fences around gardens or crops, and protective fences shielding athletic facilities such as tennis courts, ball fields, driving ranges and swimming pools are exempt from height restrictions provided the portion above four (4) feet where no setback is required, or eight (8) feet where a setback is required, is at least 80% sight permeable.
4.3.6.4 Other regulations
(a) The side of the fence or wall designed to be viewed shall face outward, away from the area or use being enclosed.
(b) Temporary snow fences shall be permitted only between November 15 and April 15 of each year.
4.3.6.5 Nonconforming Fences
(a) Fences which do not conform to the requirements of this bylaw but which were erected prior to the town meeting vote adopting this bylaw section 4.3.6 shall be considered legal nonconforming fences.
(b) A legal nonconforming fence may be repaired or replaced with in- kind material. Replacement of a fence with materials different in kind from the materials of the original fence shall be considered to be a new fence that must comply with the requirements of this bylaw.
4.3.6.6 Fences requiring a permit or special permit:
(a) A temporary or construction perimeter fence not exceeding six (6) feet in height or such other height as may be required by the State Building Code may be allowed for the period of the event requiring the temporary fence or for the duration of construction by permit from the Board of Selectmen.
(b) A protective perimeter fence that does not comply with this Bylaw may be erected in the interest of public safety and to protect an enclosed area and the property therein or to deny access to a potentially dangerous property or location by permit from the Board of Selectmen.
(c) Permits under this section may be issued for a maximum of one year and may be reissued for one additional year.
(d) No fence under this section 4.3.6.6 shall remain in place for more than two years except with a special permit from the Planning Board under Section 6.2 of this bylaw.
4.3.6.7 Penalty and Enforcement:
(a) Any person found to be in violation of Section 4.3.6 of this Bylaw shall receive a written warning and a minimum of thirty (30) days to remediate all violations thereof prior to the institution of any enforcement action.
(b) Whoever violates any of the provisions of Section 4.3.6 of this Bylaw shall be punished by a fine of not more than fifty dollars ($50) for each day during which the violation continues.

ARTICLE 10: To see if the Town will vote to appropriate from the Cemetery Sale of Lots account the sum of $1,500.00, or any other amount, for repair and maintenance projects at town cemeteries, or to take any other action relative thereto.

ARTICLE 11: To see if the Town will vote to transfer from certified Free Cash the sum of $75,000.00, or any other amount, to the Stabilization Fund, or to take any other action relative thereto.

ARTICLE 12: To see if the Town will vote to raise and appropriate and/or transfer from available funds the sum of $5,000.00, or any other amount, to pay to the Friends of Prospect Lake to help with the costs of weed control at Prospect Lake, or to take any other action relative thereto.

ARTICLE 13: To see if the Town will vote to accept funds being provided by the Commonwealth of Massachusetts under the provisions of Chapter 90 of the General Laws, to pay for such costs as allowed by appropriate legislation in connection with the maintenance, repair, and construction of Town ways and bridges, or to take any other action relative thereto.

ARTICLE 14: To see if the Town will vote to amend General Bylaw 1, Section 1 which reads as follows:
Section 1: Attested copies of all Town Meeting Warrants shall be posted in four (4) public places or more, within the Town, for at least fourteen (14) days before the holding of said meeting.

ARTICLE 15: To see if the Town will vote to adopt the following General Bylaw 23:
“The owner of a property, and his tenants or licensees, or assigns shall as soon as practical after any snow fall or ice storm, cause all public sidewalks abutting said property to be cleared of such snow and/or ice, and said sidewalk to be made usable and passable in a reasonably safe manner. The penalty for violation of this bylaw is $10 for each such violation thereof, and each day shall constitute a separate offense for an ongoing violation.”, or to take any action relative thereto.

ARTICLE 16: To see if the Town will accept easements to maintain fire hydrants granted by various Egremont property owners, as described in "Fire Hydrant Easement Agreements" to be executed, which Easement Agreements will be available for review at the Town Clerk's Office, or to take any other action relative thereto.

ARTICLE 17: To see if the Town will vote to authorize the use of revolving funds for the following programs and purposes:
a. French Park ($2,000.00)
b. Home Composting Bins ($500.00)
c. Zoning Board of Appeals ($1,000.00)
d. Dog Fund ($1,000.00)
e. Inspector Wages ($15,000.00) (exceptions: Building Inspector and Health Inspector)
which revolving funds together shall not exceed the sum of $19,500.00, which shall be under the control of the Town Treasurer, which shall be accounted for separately and to which shall be credited only the departmental receipts received in connection with the programs supported by each revolving fund; further to authorize the Town Treasurer to expend from such funds in accordance with the provisions of M.G.L. Chapter 44, Section 53E1/2 as amended by Section 72 and 73 of the Acts of 1994 of the Massachusetts General Laws, provided however that said expenditures for all revolving funds shall not exceed the receipts for such funds, or to take any other action relative thereto.

ARTICLE 18: To see if the Town will vote as follows: “Shall the Town raise and appropriate (or alternatively pay out of the Town’s free cash) $14,000 (or any other amount) for the purchase and installation of new playground equipment at French Park? Such amount, when added to the $5,000 already set aside for this purpose from the net proceeds of Egremont on Parade, thereby totally $19,000, shall be spent only to the extent matched by an equal amount provided by the French Park Fund and/or by other non-Town sources, so that the Town will effectively pay only one-half of the cost of purchasing and installing such equipment.” (Citizens petition.)

ARTICLE 19: To see if the Town will vote to raise and appropriate and/or transfer from available funds the sum of $13,000.00, or any other amount, to install emergency warning sirens in Egremont or take any other action relative thereto. (Citizens Petition.)
